Well the Second Circuit will take the appeal if he makes it. The NFL can apply for a stay which will keep the suspension in force but I would bet heavily that they will not stay the ruling. However, if they rule that the suspension was legal then the 4 games will kick in whenever that happens to be. So let's say the ruling comes down in December and they decide it was OK. Then old Tommy will be missing some playoff games.

What happens if they apply for stay and then it's thrown out? Like how do you give Brady those games back?

Precisely why a stay is unlikely to be granted

Ah ok, for some reason didn't click that an application would (obviously) need to be granted.

The Saints are gonna stink this year.

However, I'm looking forward to watching Peat and Armstead develop as a tackle duo (if they are employed that way).

Bridgewater as a backup

Not bad, really, this could be Teddy's breakout year. I got Matt Ryan with Flacco as backup in one of mine, Romo and Mariota, and Peyton and Kaep the others.

Don't get me wrong I like him. Just thought that even 12 games of Tom Brady as a backup and Romo with the leverage to trade would have been dynamite

after reading judge berman's ruling you really think the second circuit will hear it? i mean, the ruling really read like the nfl was being told their case was a complete joke (which it is).

Depends. They will only review it for a question of law. So the real question is a labor law question. Since the NFLPA stupidly agreed to the absolute kangaroo court procedure are they then bound by it. I've long thought the NFL made a pretty big mistake in going so ridiculously hard for the procedure where one with slightly less ridiculousness would have been almost as stacked in their favor. Arbitration orders are rarely interfered with but in this case the process has no notion of real due process which subjects it to attack. The only question is whether a labor union can waive all forms of due process in an agreement. Anyway what I'm hearing is no way this get's resolved this year so Tommy's good for now.

NFL Owners have to be pissed at Goodell actually getting disciplinary authority tested over such a piddly shit matter

A couple of interesting points - can a union abdicate authority to the extent the nflpa did in the cba - judge berman technically didn't touch on that specifically..or did he? I mean, I do t think he specifically mentioned the extent of roger's authority at all, or at least that's not what I read in the decision.

Also, I 100% agree that the owners wod have preferred that goddell try to exercise his authority in their behalf on a matter that actually matters.

All in all, doesn't this boil down to "law of the shop", which basically says workers need to be generally aware (no pun intended) of what actions will lead to a suspension? Like, due process and the system aside, it read like judge berman told the NFL that they were not only aritrary in the punishment, but arbitrary in what Brady was accused of being in breach of...you can't kinda sort of reference a bunch of different policies (except when the NFL specifically likened being generally aware of equipment guys changing ball pressure to substance abuse even though the only football issues to ever be treated like ped use are instances of ped use) and then lump it together as "conduct detrimental" and then somehow land on 25%. I seriously don't see how this decision can be overturned, but then again, I don't have a law degree.

Well, shit. That's genuinely great news for the guy. I gave him little to no chance when he made the decision to leave but I'm very happy to be proven wrong. I'll be following his progress with a lot of interest and wish him the best for sure.

Keep me updated, guys. I'd like an American perspective.

I've seen legal scholars who say the ruling is pretty poor legally. The NFL will probably appeal and might even win. It'll probably take eight months, though. Brady can just retire at that point. This has happened before.
