I thought it was an interesting analysis. And yes it's big enough to drive a truck through and every big player should be able to get paid doing this. But remember the bold is just speculation on the part of the author (probably accurate speculation) and is not under the rules why he can collect. They're just creating an exception for lawsuit awards.

The ACC voted to up the exit fee to $50 million after Notre Dame joined last fall and Maryland voted against it. Later Maryland got the invite to join the Big Ten and jumped on it immediately. The ACC filed a lawsuit against Maryland in North Carolina to collect the money. Maryland asked to have the lawsuit dropped since they are state-funded and have sovereign immunity from lawsuits like the ACC's, but the judge in North Carolina ruled that sovereign immunity doesn't exist in contractual cases like the one with the ACC. That's basically all I know.

They'll most likely have to pay the $50 million. Sovereign immunity under almost no theory I can think of can apply in this case. Even if it did all of the other public institutions in the ACC would be perfectly free to sue Maryland for not paying the exit fee.

A fair amount of this was already available with a cursory googling since it was widely reported in the 90s. They needed to hire someone who was completely clean out of a clean program; between this and Jordan it's fairly clear that their background checks here were nonexistent. The fact that the Ledger has video both of the wedding stuff happening and Hermann denying the wedding stuff happened is going to be what causes the rolling of the heads if such happens.

I don't see any way that the players aren't paid soon, at least at the big colleges. I'm hearing some talk of a new division with only the big conferences where players would receive a stipend. Due to Title IX I think that means everyone in the athletic department has to get the same stipend, so only the rich schools could afford it. I would be okay with that.

Of course there's also the concussions issue which is another thing challenging the NCAA right now.

Well that was a rough loss. I feel horrible for Jordan Matthews. He's the only reason we're in the game still and if he catches that Vandy probably wins. Kid gave it his fucking all. He's going to be good on Sundays.
